**By purchasing or acquiring any art or design I have made the client or clients -referred to in these Terms of Service as "the client", consumer, customer, you, your, and/or yourself- are agreeing to these terms of service of the seller- referred to in these Terms of Service as "the seller", Mystic Mahogany Studios, choasblast03, cowgirlknight, I, me, mine, my, and/or myself. This agreement is considered binding regardless of how it was acquired.**The phrase "art or design I have made" when stated within these Terms of Service includes but is not limited to the following products when made or are in the process being made by myself: Adopts, Customs, Character designs, redesigns, gifts, line arts, reference sheets, artwork, Works-in-Progress, sketches, and concept pieces.**The phrase "art I have made" when stated within these Terms of Service includes but is not limited to the following products when made or are in the process being made by myself: gifts, line arts, reference sheets, artwork, Works-in-Progress, sketches, and concept pieces.**The phrase "design I have made" when stated within these Terms of Service includes but is not limited to the following products when made or are in the process being made by myself: Adopts, Customs, Character designs, and redesigns.**The phrase "regardless of how it was acquired" applies to but is not limited to the following methods of acquisition for any art or design I have made: commissioned, gifted, traded, purchased, included, transferred, resold, re-traded, re-gifted, recycled, illegal acquisition, downloaded, digitally copied, photo-copied, emailed, sent, received, video recorded, screen-captured, printed, photographed, scanned, faxed, telegrammed, encrypted, decrypted, translated, viewed, clicked, tapped, long pressed, swiped, picked up, lifted, handled, injected, and consumed.Failure to abide my Terms of Service will result in a Blacklisting!Design Resale pricing: You may not resell any design I have made for more than their initial sale cost (Set by me, the design creator) Unless the design has additional art acquired after the initial purchase. This policy holds for designs I have made regardless of how it was acquired.Art and/or Design Ownership Changes: If any art or design I have made is going to be acquired by a new owner at your discretion be sure my Design Crediting and/or Toyhouse Crediting is not lost or missing, as this could result in you and/or the new owner becoming blacklisted by failing to maintain compliant to my Design Crediting and/or Toyhouse Crediting Terms of Service. This policy applies to any art or design I have made regardless of how it was acquired.Design Crediting: Any art or design I have made must be credited to me as Choasblast03 or Mystic Mahogany Studios. Any art or design I have made should be linked back to either @choasblast03 on Instagram, and/or @cowgirlknight on Deviantart.Toyhouse Crediting: If you put any art or design I have made on Toyhouse, it must be credited directly to my Toyhouse account Choasblast03, do NOT link design/art credit on Toyhouse to my DA, Instagram, or Discord.Alterations/Edits: You may not draw on or edit any art I have made unless my explicit permission is acquired.

I reserve the right to require an additional fee for commercial use even if this fee is to be applied after acquisition of the art I have made regardless of how it was acquired.
This policy does not apply to any design I have made, as they may be used at your discretion.NFTs : I do not allow any art or design I have made to be used for NFTs and/or cryptocurrency. No art or design I have made is to be used as an NFT and/or cryptocurrency regardless of how it was acquired. No art or design I have made is to be used as part of an NFT and/or cryptocurrency regardless of how it was acquired. No art or design I have made is to be used as a concept, reference, or prototype of an NFT regardless of how it was acquired. I do NOT take commissions to create NFTs.AI Art algorithms: I do not allow any art or design I have made to be used for training AI regardless of how it was acquired. No art or design I have made is to be used for AI training or resources in any capacity regardless of how it was acquired. I do not take commissions to create training materials for AI.Returns: I do not accept returns for paid work under any circumstances.Refunds: I do not do refunds for any completed work at any time.Cancellations: I do not do refunds for any completed work, should a commission be cancelled at any time, refunds are my complete discretion up to 100% depending on work completed. Please talk with me about any cancellations as I will work with you, but my refund decisions are Final.Refusal of Service: At any time, I reserve the right to refuse and/or cancel a commission if I feel uncomfortable doing it. Should this be after payment, a refund up to 100% may be issued. I state it this way only to retain my rights to cancel without refund or with partial refund as up to 100% includes 0%. Reasons this may occur include but are not limited to: lack of communication, harassment, blacklisting, or unforeseen circumstances. The amount refunded remains entirely at my discretion should a cancellation of this nature occur. This is not to scare you, this is for my protection. The internet can be nasty place.Reuse of Work Rights: I retain the right to use any compositions, poses, designs, or lines that were not used in the final result of a commission in any capacity at my discretion.Portfolio Rights: I retain the right to use any art or design I have made for use in my professional portfolio and as an example of my work at my discretion. This includes but is not limited to the following: Usage on promotional material for Commissions and/or Customs, Usage on example sheets, Usage on comm sheets, Usage in portfolio submissions or reels for work applications.Design Purchasing: Any flat-sale or auction purchases of a design I have made must be paid within 48 hours after your offer has been accepted unless otherwise discussed and given my explicit agreement.
Any art payments for a design I have made must be paid within the window I have set with you, the customer, at the time of accepting your offer.
Any other forms of offer-to-adopt payment for a design I have made must be paid within 48 hours after your offer has been accepted unless explicitly stated by myself.
Failure to complete payment within the allotted time window will result in your offer becoming nullified, at which time I may reopen to offers or accept another current offer at my complete discretion.Conduct: If you contact a potential buyer or bidder before, during, or after a sale / auction / raffle for the purpose of intimidation, harassment, or any manipulation that would affect their decision to bid/buy, you will be blacklisted from all future sales. The method of communication (comment section, notes, discord server, etc) is irrelevant and will be treated with the same level of severity.Blacklisting: I reserve the right to alter, add to, and/or subtract from my personal blacklist at my discretion and reserve all rights to not provide explanation and withhold comments when asked. I will usually notify the client being added to the blacklist once that they have been blacklisted, but that courtesy along with anything else is entirely at my discretion. I reserve to right to refuse service and/or contact to anyone on my blacklist without explanation at any time.**I reserve the right to alter my Terms of Service at any time at my complete discretion. It is your responsibility to remain up to date with my Terms of Service at the time of purchase, and at any time a New Usage of any art or design I have made is considered or put into effect. New Usage of an art or design I have made includes but is not limited to the following: Sale, new ownership, commercial usage, AI usage, NFT usage, cryptocurrency usage, gifting, trading, crediting, and alterations. It remains your responsibility to be up to date with my Terms of Service at the time of purchase or New Usage regardless of how it was acquired.

Reference Sheets From Existing Images = Ref FEI
Reference Sheets From Concept = Ref FC
A Ref FEI comm is not a Redesign commission. This comm type is to create a reference for an already existing design, allowing for minor edits.
Ref Sheets will always be coloured and never shaded, for ease of use. These works will require me to contact you more frequently as I work (especially for Ref FC comms) to make sure the character is being represented faithfully. These checks will include all the checks used for Regular commissions with additional consultations during the rough sketch phase to double check proportions and design needs. If it is a Ref FEI comm these checks will serve to check any tweaks to the design we will have discussed before I start working, and add more tweaks if you only see them after the design is in front of you (it happens XD) Designing is extremely fickle, I am aware and very patient with this.
